EU DOCUMENTS IN THE SEJM

In April 2017 the EU Affairs Committee (SUE) held 7 meetings: no. 121-127. During these meetings the Committee:

  • scrutinised 67 EU documents:
    • pursuant to Art. 7(4) of the Cooperation Act – 8 EU draft legislative acts concerning i.a.: internal market for electricity, promotion of the use of energy from renewable sources and European business statistics,
    • pursuant to Art. 151(1) of the Sejm Standing Orders and Art. 3(2) of the Cooperation Act – 38 EC documents (8 communications, 24 reports, 2 proposals for regulations, 2 proposals for directives, 1 joint communication and 1 annual review) concerning i.a.: Facility for Refugees in Turkey, quality of fiscal data reported by Member States in 2016 and progress made in the implementation of the EU-Turkey Statement,
    • pursuant to Art. 11(1) of the Cooperation Act – EU documents, which were to be discussed by General Affairs Council,
    • pursuant to Art. 8(2) of the Cooperation Act – 8 EU draft legal acts concerning i.a.: the position to be adopted on behalf of the EU at the Eighth Conference of the Parties to the Stockholm Convention on Persistent Organic Pollutants, amendment to the regulation on certain fishing opportunities and position to be adopted, on behalf of the European Union, in the Joint Committeeof the Regional Convention on pan-Euro-Mediterranean preferential rules of origin,
  • took note of information of the Minister of Foreign Affairs on negotiations on the UK's withdrawal from the EU under Article 50 of the Treaty of Lisbon - Poland's goals (presented by Secretary of State in the Ministry of Foreign Affairs Konrad Szymański) (mtg no. 121),
  • scrutinized: information on the Foreign Affairs Council meeting planned for 29 April 2017 (presented by Secretary of State in the Ministry of Foreign Affairs Konrad Szymański) and information on the position the Council of Ministers had taken in the EU Council pursuant to Art. 3 (2) of Protocol no. 36 on transitional provisions (presented by Undersecretary of State in the Ministry of Justice Marcin Warchoł) (mtg no. 123),
  • held the meeting with Michel Barnier, Chief Negotiator of the European Commission's Task Force for the Preparation and Conduct of the Negotiations with the United Kingdom under Article 50 TEU (mtg no. 124),
  • heard information on the British Government's strategy for departing the European Union presented by J.E. Jonathan Knott, Ambassador of the United Kingdom (mtg no. 125),
  • adopted opinion no. 20 on documents COM(2016) 759 and 860 (mtg no. 126),
  • together with the Public Finances Committee and Economy and Development Committee heard information on Convergence Programme and National Reform Programme prepared by Poland in connection with the implementation of the European Semester in 2017 (presented by Undersecretary of State in the Ministry of Finance Leszek Skiba and Undersecretary of State in the Ministry of Development Adam Hrymszczak) (mtg no. 127).

  • 20.04.2017, considered the information presented by the Secretary of State in the Ministry of the Interior and Administration – Jarosław Zieliński on the state of play of the European Parliament and Council Directive (EU) 2016/680 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data by competent authorities for the purposes of the crime prevention (mtg no. 57);

  • 06.04.2017, considered information on Poland's fulfillment of the conditions enabling the activation, in the new financial perspective, of EU funds for waste management (mtg no. 64);

    • Act of 23 March 2017 amending the act on the collection, storage and transplantation of cells [1332],
    • Act of 23 March 2017 on mortgage credit and on the supervision of mortgage credit intermediaries and agents [1210],
    • Act of 23 March 2017 amending the act on - Penal Code and some other acts [1186],
    • Act of 24 February 2017 amending the act on the prevention of pollution from ships and some other acts [1194].

ALL REASONED OPINIONS OF NATIONAL PARLIAMENTS IN IPEX

In April 2017, 18 draft legislative acts were subject to subsidiarity scrutiny. As of 8 May 2017, the national parliaments submitted 5 reasoned opinions on the non-compliance of the scrutinised draft acts with the subsidiarity principle.

* In March 2017 reasoned opinions to the documents COM(2016) 861 and COM(2016) 863 were submitted - see the previous Bulletin OIDE – March 2017. Furthermore, in March 2017 the German Bundesrat  adopted a reasoned opinion to the document COM(2016) 861, but this information appeared in the IPEX database after the March Bulletin OIDE was published.
